ADA Compliance Services Could Have Saved them Millions

In Seyfarth Shaw LLP’s February 18, 2026’s blog, they review the ADA website compliance lawsuit of Alcazar v. Fashion Nova, Inc. The post goes into the specifics of the Department of Justice’s involvement in their filing a Statement of Interest opposing a proposed settlement. Normally they do not intercede in day-to-day cases, but this one is of particular interest to them (and us here at website-compliant.com) because this case is of a federal class action lawsuit and the company being sued resides in and does, “significant business” in the state of California.

The numbers here are staggering and should be taken as a serious warning to all non-compliant businesses in California. Fashion Nova has agreed to pay approximately $2.43 million to everyone in the state who submits a valid claim AND an additional $2.52 million in fees and costs to plaintiff’s counsel.

The DOJ is not arguing in favor of rejecting the proposed settlement because it is too much money, but rather for two reasons (among many others); first, because they say it would not increase Fashion Nova’s websites’ accessibility and, second, because the attorney’s fees are unreasonable far and above the monetary compensation of the class members themselves.

In a twist of irony, the website that individuals would need to submit claims to in this case is not itself compliant, meaning that those who are blind and tried to use Fashion Nova’s website, cannot seek relief as they should be allowed to!

These are just a few of the main points demonstrating how new the subject of website accessibility and its laws are to the business world, and how entangled a non-compliant business can become if they are not careful. A review of your website before becoming embroiled in a monetary and stress-inducing nightmare like this then makes all the sense in the world.
